Website Hosting Use Policy

Each customer (a "Customer") of NetroStar, Inc. ("NetroStar") who has executed a Website Hosting Agreement (the "Agreement") or has opened an account with NetroStar covenants and agrees to the following Website Hosting Use Policy (the "Policy"):

  1. General.
    Each Customer is responsible for the activities of its users and, by accepting service from NetroStar, is agreeing to ensure that they abide by this Policy. Complaints about Customers or users of a Customer will be forwarded to the Customer for action. If activity in violation of this Policy continues, then the Agreement may be subject to termination or other action as NetroStar deems appropriate without notice. NetroStar has the right to terminate the account of an offending Customer or take other action as NetroStar deems appropriate without notice. NetroStar reserves the right to modify this Policy at any time, effective upon posting to this site. NetroStar has no practical ability to monitor all conduct, communications, or content which might violate this Policy prior to its transmission on NetroStar's network. Therefore, NetroStar does not assume liability to Customers for any violations of this Policy.

  2. Customer Responsibility.
    Customer shall ensure that its users comply with the terms and conditions of this Policy. Any access to other networks connected to NetroStar's network must comply with the rules of the other networks. Customers shall not use or permit its users to use the network in ways that violate laws, infringe the rights of others, interfere with users of NetroStar's network or other networks, or otherwise violate this Policy. For example, and without limiting the scope of the foregoing, Customers shall not utilize NetroStar's network to engage, attempt, or otherwise assist in (a) the distribution of chain letters or UBE (unsolicited bulk electronic mail); (b) the propagation of computer worms or viruses; (c) the impersonation of another person with fraudulent or malicious intent; (d) the compromising of the security, or the unauthorized access, of any site or network; (e) the distribution of child pornography, obscenity or defamatory material over the Internet; (f) the infringement of copyrights, trademarks or other intellectual property rights; (g) the interception of electronic transmissions; (h) the perpetuating of fraud; (i) the contacting of another person so as to annoy, abuse, threaten, or harass such other person; (j) Ponzi schemes, chain letters, pyramid schemes or other such scams, (k) the forging of any email message or header, in whole or in part; (l) e-mail or news bombing; (m) the use of IRC bots; or (n) any other activity or purpose in violation of law, or in such a manner as to interfere with the use of the network. Customer further agrees to comply with all United States laws concerning the transmission of technical data and other regulated materials on the network.

  3. Dial-Up Account Inactivity Disconnect Policy.
    Line camping and idle connections are not permitted. NetroStar reserves the right to disconnect a dial-up account after 15 minutes of inactivity, as detected by NetroStar through electronic means. This time is approximate and subject to reasonable change without notice in NetroStar's sole discretion. Electronic or mechanical means to avoid an inactivity disconnect are strictly prohibited. "Electronic or mechanical means" include, but are not limited to, "pinging" a server, employing electronic or software autodialer features to maintain an active connection or repeatedly checking for email by autolog-in to the mail server. NetroStar reserves the right to electronically audit connections to enforce the above restrictions.

  4. Privacy Protections.
    NetroStar may collect personal information for the purposes of billing, the provision of customer service, network management, and the provision of offers of related services. NetroStar will not disclose or share personally identifiable information collected with any other company or organization without the informed consent of the Customer providing the information, except as may be required by law. NetroStar will use information received from Customers and other individuals only for the purposes reasonably related to the subject matter of the communication. NetroStar will not use personally identifiable information about the usage patterns of its subscribers except for the provision of customized services. NetroStar will not target children for collection of personal information. NetroStar will, however, cooperate with the appropriate legal authorities in investigating claims of illegal activity.

  5. Reporting and Enforcement.
    If you are aware of a potential violation of this Policy, please direct the information to abuse@netrostar.com. The NetroStar Customer Service Department will investigate potential violations carefully before taking action. All complaints will be actively investigated, and enforcement action will be taken as appropriate. A variety of factors, including the severity of the abuse and the history of the account involved, will be taken into account in determining the appropriate enforcement action, which may include (a) the issuance of written or verbal warnings; (b) the suspension or termination of the account; or (c) the billing and collection of reasonable administrative and/or reactivation charges.

  6. Effective Date/Revisions.
    This Policy is effective as of January 01, 2006.
